Stop Power of Sale in Ontario Before the Lender Completes the Sale

A Notice of Sale Requires Prompt Attention

A missed mortgage payment does not mean the house is sold immediately, but a formal notice of sale creates deadlines that should not be ignored. Read every page, record when and how it was delivered, and contact the lender or its lawyer for current figures.

We buy Ontario houses directly for cash, including properties that need repairs or are not ready for a traditional listing. A voluntary sale may provide a way to pay the mortgage and registered claims before the lender completes its own sale, but only when the price, payout, legal work, and closing date can all be resolved in time.

Requesting or receiving an offer does not pause power-of-sale proceedings. Keep communicating with the lender and have an Ontario real estate lawyer review the notice, title, payout, and proposed transaction.

Call 905-667-6512 or request a cash offer online while you continue addressing the lender’s requirements.

An Offer Is One Part of the Response

Confirm the Deadline and Mortgage Payout Before Planning a Sale

The notice, mortgage terms, lender correspondence, registered debts, and legal costs determine what must be paid and how much time remains. A sale can work only if the transaction closes before the lender proceeds and the available funds satisfy the amounts required on closing.

Start With Verifiable Information

Three Things to Confirm After Receiving a Notice of Sale

Do not base a decision on the mortgage balance shown in an old statement or on an assumed closing date.

Read the Notice and Mortgage

Identify the default, the parties who sent the notice, the date it was given, the stated amount, and the legal process being used. Preserve the envelope and delivery information.

Request Current Payout Figures

Ask for an up-to-date amount that accounts for principal, interest, arrears, legal fees, enforcement expenses, taxes, and other charges the lender says must be paid.

Get Independent Legal Advice

A lawyer can review service, timing, title, registered claims, redemption options, sale documents, and whether a proposed closing can satisfy the lender’s requirements.

Understanding the Process

What a Power of Sale Means for an Ontario Homeowner

A power of sale allows a mortgage lender to sell the mortgaged property after default without first becoming its owner through foreclosure. The lender uses the sale proceeds to pay enforcement expenses and amounts secured against the property according to their legal priority.

The Ontario Mortgages Act contains different timing rules depending on the power being exercised. Where the mortgage itself provides a power of sale, section 32 says notice cannot be given until the default has continued for at least 15 days and a sale cannot occur for at least 35 days after notice. The statutory power under Part II has a separate 45-day notice provision.

Those minimum periods do not tell you the exact date or rights in an individual file. The mortgage, type of power, method of service, later correspondence, court activity, and any agreement with the lender all matter.

Do Not Wait for the Final Day

A Home Sale Still Needs Time to Close

An offer must be reviewed, a purchase agreement signed, title searched, payout statements ordered, funds arranged, and closing documents completed.

Registered claims, tax arrears, condominium amounts, ownership disputes, or a shortfall can add work.

Ask the lender and your lawyer what date actually controls instead of calculating a deadline from a general webpage.

Power of Sale

The Lender Sells the Property to Recover the Debt

The borrower remains the registered owner until the lender completes the sale. After authorized expenses and secured claims are paid in the required order, any remaining residue is generally payable to the borrower.

The lender does not simply keep all equity, but enforcement expenses, interest, later-ranking claims, repairs, and the eventual selling price affect what remains.

Foreclosure

Foreclosure Seeks Ownership Through a Court Process

Foreclosure and power of sale are not interchangeable terms. Foreclosure is a court process through which the lender may seek ownership of the property, while power of sale is focused on selling it to recover the mortgage debt.

If the documents refer to foreclosure or a court proceeding, review our Ontario foreclosure information and obtain legal advice about the actual proceeding.

Selling Before the Lender Does

Can a Voluntary House Sale Stop Power of Sale?

It may, but a signed offer alone is not enough.

A voluntary sale can resolve the mortgage when the transaction closes in time and produces enough money to satisfy the lender and other amounts that must be paid from the property. Your lawyer coordinates title, payout statements, registered claims, closing funds, and communication with the lender’s lawyer.

When the expected proceeds are lower than the required payout, the sale may not be able to close without the lender’s agreement and another source of funds. Do not promise a buyer clear title until the shortfall and every registered claim have been addressed.

Continue following the lender’s instructions until your lawyer confirms that the matter has been resolved. We cannot suspend, cancel, or extend a lender’s enforcement process.

Sell the House in Its Current Condition

Repairs May Not Be the Best Use of Limited Time

Power-of-sale deadlines can make a long renovation plan unrealistic. We evaluate houses with deferred maintenance, damage, outdated finishes, unfinished work, and belongings that have not been removed.

The repair needs affect the offer, but you can compare a direct purchase before spending more money or losing time to contractors and listing preparation.

A Direct Sale Still Requires Due Diligence

How Our Cash Home-Buying Process Fits the Situation

First, tell us the address, condition, occupancy, known repairs, notice date, and the deadline provided by the lender or its lawyer. We review the property and determine whether we can make an offer.

If you want to proceed, review the written purchase terms with your lawyer. The lawyer then confirms title, payout amounts, registered claims, adjustments, required funds, and whether the proposed closing date is achievable.

The sale is complete only when closing occurs and the required funds and documents are delivered. Until then, continue responding to the lender.

Ask About Mortgage Solutions

A Sale Is Not the Only Possible Response

Ask the lender whether reinstatement, repayment arrangements, refinancing, a term change, or another written solution is available. Eligibility depends on the mortgage, arrears, income, equity, lender, credit, and timing.

A licensed mortgage professional, lawyer, or nonprofit credit counsellor may help you understand options outside a sale. Avoid anyone who guarantees approval or asks you to conceal information.

Compare Selling Methods

Traditional Listing or Direct Cash Sale

A listing may reach more retail buyers when the house is market-ready and enough time remains. It can also involve repairs, showings, inspections, buyer financing, commissions, and an uncertain closing schedule.

A direct sale may reduce preparation and financing uncertainty. Compare the written offer, realistic net proceeds, closing requirements, and lender deadline with your lawyer before deciding.
